Trans in the Spotlight!

In the Spotlight! Trans in the Recommendation of the Committee of Ministers to Member States on measures to combat discrimination on grounds of sexual orientation and gender identity

 
The Recommendation is the first and only agreement between governments to combat discrimination against transgender, and bisexual, lesbian and gay people in Europe. It defines a set of concrete measures member states should implement to improve the human rights situation in their country. Concerns of trans people are included throughout and in specific areas, such as:
  • Change of name and gender marker in all areas of life
  • Access to Health without Discrimination
  • Trans-related Health Care
  • Trans in Employment
  • Other areas
 What is the Recommendation? Why does it matter?
 
The Spotlight publication gives an overview what the recommendation is, why it matters to trans people and what should be done by member states to its implementation.

ILGA-Europe and TGEU are pleased to launch the Human Rights & Gender Identity Best Practice Catalogue
 
Human Rights & Gender Identity Best Practice Catalogue is a follow-up to Commissioner Hammarberg’s landmark 2009 Issue Paper. It presents a number of policy, legal and practical inspirations from countries in Europe and beyond on how the 12 recommendations contained in the Issue Paper could be implemented. TGEU and ILGA-Europe are pleased to have jointly contributed towards this document and hope that it will be useful for the advancement of equality of trans people in all spheres of life. On the one hand, the document is a response to the frequent requests for information received from activists and policy makers alike, and on the other hand it wants to stimulate greater political leadership for the overcoming of (perceived) obstacles through reference to existing examples that work.
 
Without a doubt, the presented practices are not fully complete since there is more out there that is not covered by this one publication, and the models presented are certainly not the only way on how to improve the living situation for trans people. We remain open to receiving more information on good practices that can help supplement the ones included in the document. TGEU STATEMENT: SOCIAL INCLUSION THROUGH SUSTAINABLE TRANSPORT

TGEU Statement on Social Inclusion through SustainableTransport

Public space and usage of public transport is for many trans persons in Europe a dreadful experience. Transgender Europe shows how trans passengers often are affected in their safety, security and dignity by staff and fellow passengers. 79% of trans people in an EU-wide survey reported harassment in public; 43% of trans respondents in a national survey feel “less well treated” in the street. This statement also presents best practices and 10 concrete recommendations aiming to inspire dialogue and yield sustainable improvements.

Recommendations

 

Based on the findings, TGEU recommends the following measures be undertaken at the earliest possible by those responsible for sustainable mobility management in Europe as mechanisms to help achieve social inclusion and in turn the safety and security of transgender persons:
 

1) Acknowledge the responsibility and positive duty public transport has towards the rights of all passengers inclusive of trans persons.


2) Take measures to effectively ensure safety and security of trans persons, particularly in public transport.
 

3) Review existing regulations and practices to remove any structural barriers trans people may face in accessing public transport, particularly regarding rights, safety and security concerns.
 

4) Remove wherever possible references to gender on reduction cards, smart cards and other personalized ticketing systems.
 

5) Make public transport a positive and welcoming experience for trans people as passenger or staff. To this end, enable PT operators and staff to engage appropriately and respectfully with a diversity of passengers inclusive of trans people, by e.g. diversity trainings, in-house awareness campaigns, trans-inclusive recruitment[1], co-operations with local and national trans groups.
 

6) Assess specific needs trans persons might have towards public transport, by means of user surveys and quality reviews, and particularly in regard to safety and security.
 

7) Nothing about us, without us! - engage in constructive dialogue with trans people and their communities.[2]
 

8) Raise public awareness of fellow passengers about the trans inclusiveness of public transport with a clear message of “zero tolerance” to those transphobic by means of campaigning.
 

9) Develop and implement effective complaint mechanisms taking seriously and quickly following-up on complaints related to bias-motivated discrimination or violence. This might include a compensation system for victims of such crime.
 

10) Actively promote “sustainable mobility for all” to trans communities by means of joint initiatives.

TGEU and ILGA-Europe highlight obstacles trans persons face in regard to cross-border prescriptions in the EU

Joint contribution from ILGA-Europe and Transgender Europe on measures for improving the recognition of prescriptions issued in another EU member state

The contribution to an EU consultation highlights a number of obstacles trans persons face when trying to get medicines prescribed in another EU member state.

 

ILGA-Europe and TGEU point out in particular the following key concerns:

  • We are worried by the fact that in some cases, trans persons were denied products on the basis that dispensers disapprove of their gender reassignment.
  • It seems that some medicines, on which trans persons very much depend, are available only in some member states and not in other.
  • We consider that the identification of the patient based solely on the first name or on the gender can be problematic in the case of patients whose appearance does not match the first name and the gender mentioned on the prescription.
  • It seems that there is an extensive lack of knowledge within the trans community about the possibility of getting medicines prescribed in another member state.

Report on gender discrimination in employment and access to goods and services - June 2011

 

 

Does EU-protection from gender discrimination work for trans people? How are EU gender equality laws implemented in member states when it comes to trans people?

In June 2011, ILGA-Europe and Transgender Europe have made a joint submission towards the European Commission's monitoring of the implementation of the Gender Goods and Services Directive (Dir 2004/113/EC) and the Gender "Recast" Directive (Dir 2006/54/EC) in the EU Member States.

ILGA-Europe and TGEU recommend to the European Commission to...
  1. proceed to the review of the implementation of both directives with a particular focus on discrimination based on gender identity and gender expression
  2. call on Bulgaria, Italy, Liechtenstein, Malta, Poland, Portugal and Romania to amend the restrictive understanding of their national law implementing both directives so as to ensure a minimal protection against discrimination on the ground of gender identity and gender expression
  3. ask for clarifications to Cyprus, Iceland, Latvia and Luxembourg where the coverage of gender identity and gender expression by national legislation remains unclear
  4. launch an infringement procedure against those Member States that do not undertake the necessary changes 
  5. undertake a legal analysis of requirements for gender recognition legislation (i.e. change of name and legal gender) and their requirements in Member States towards their compatibility with both directives
  6. liaise with the Member States to ensure that national equality bodies investigate cases of discrimination on the ground of gender identity and gender expression
  7. ensure that national authorities and equality bodies give publicity to the coverage of gender identity and gender expression in their anti-discrimination policy
  8. promote good practices put in place in some of the Member States in the field of gender-based discrimination
  9. organise „train the trainers programmes on legal issues designed for Member States
  10. encourage Member States to organize trainings on discrimination issues for the judges and all the legal officers and national equality bodies officers (with a particular focus on the situation of transgender and intersex people)
  11. liaise with DG SANCO to develop measures targeted at improving the access of trans-people towards general health-care provision such as educational programs combating prejudice among medical practitioners and offering guidance on development and implementation of trans-friendly treatment guidelines to all Member States
  12. commission research on discrimination against intersex people and how to best cover them under the existing EU legal framework.

We want your input! How does EU law work in your country?

 

The next report will be submitted in February and will look at the following areas:

Report on the implementation of 2004/113/EC Gender Goods and Services and 2006/54/EC Gender Recast Directive ILGA-Europe, Transgender Europe and OII-Germany will look at the implementation of this directive with regard to sex, gender, gender identity, and gender expression. Please refer to the Guidelines (particularly pgs 28-30) and assess your country’s efforts to promote equality for lesbian, bisexual women, trans and intersex people through these directives.

We want your input!

We surely want to provide input in terms of:
-       access to justice (equality body or equivalent) as all countries should have such a body in place,

and impact of the directive in reducing discrimination in: 

-       access to goods and services – particularly healthcare –  but also all forms of contracts, buying/ selling etc.
-       employment and workplaces.

It will thus be relevant for your respective organisations to send us input in terms of:
-       any efforts that are conducted nationally to promote equality for all, including sex, gender, gender identity, and gender expression (campaigns, publicly financed programmes, publications etc.)
-       the knowledge of the legislation in workplaces and society at large.

-       Cases of discrimination (discriminatory comments by Ministers etc
will also be useful) or
-       statistical data on discrimination.
