Overview of legal situation on trans issues in the EU
In the download section you find an overview of the legal situation that trans people face in the EU member states made up from paragraphs on transgender issues from the individual country reports of the recent EU Fundamental Rights Agency's Report on Homophobia. The report analyses comparatively key legal provisions, relevant judicial data, such as court decisions, and case law in the Member States. The document gives a good overview of the human rights problems that trans people face throughout the whole EU. The result of this little exercise is a quite apalling outlook on the legal situation that trans people face, and sheds a light on some very severe human rights violations in the EU. Justus Eisfeld, who put together the document added as well a very helpful synopsis of some of the findings of the country reports. download here

Lithuania - Ombudsman upheld case
According to the Lithuanian newspaper 'Lietuvos Rytas' (14.2.09, paper edition) and the journal 'Ekstra' (17.2.09;http://www.lrytas.lt/-12348278751233169608-p1-transsekualumas.htm) the Lithuanian Ombudsman has upheld a case by a trans person against the refusal of the Ministry of Health to allow transgender treatment - according to the Health Ministry currently this is 'not legalized' in Lithuania. The case has now been passed back to the Ministry, and the chairmen of the parliamentary health and human rights committees, for review. In 2007 Lithuania lost a similar case (L. v Lithuania) at the European Court of Human Rights, forcing the Health Ministry to pay 45,000 Euros to the trans person involved.

what are the most common stereotypes on trans people
In order to improve the impact the European TransGender Network can have with politicians, policy makers or simply with the lady next door in explaining what transgender rights are and why they are needed, we have to understand what people have in mind when they think "transgender" or "transsexual" or "gender disphoric" or or or...
so, we want to find out what are the most common stereotypes/ pre-judices on trans people.
Please read the list of stereotypes we came up with so far and help us in counter-arguing them as well as completing the list. In your answers give -if possible- reference to facts&figures. Be short, precise and matter-of-fact. Which stereotypes are missing here and need to be mentioned?
You can find the list of stereotypes here: http://www.tgeu.org/forum/viewthread.php?forum_id=8&thread_id=6 (you have to register at www.tgeu.org in order to read/ participate in the online discussion).
Your input is very much appreciated -preferably before January 15th!
Thanks in advance and nice holidays to everybody!

Transgender people face fear and hate across Europe
Attitudes towards gays and lesbians in much of Europe and around the world may have made remarkable advances over the last 20 years, even if some regions of the EU are more hospitable than others. But for transgender people, discrimination, marginalisation and outright hostility remain part of daily experience. Human Right Commissioner, Thomas Hammarberg: "Transgender people have a right to human rights protection like everyone else. The time has now come for the human rights movement to start taking the concerns of transgender persons seriously."

expert meeting on transgender at Council of Europe
Press Release of Transgender Europe for immediate usage Strasbourg, November 18th 2008
expert meeting on transgender held at Council of Europe
Human Rights Commissioner of the Council of Europe, Thomas Hammarberg, held today an expert meeting on the Human Rights Situation of Transgender People and Discrimination based on Gender Identity at the Council of Europe.
Mr. Hammarberg stated earlier this month that “all transgender persons should be protected against discrimination on the same footing as other groups.” He called the problems of transgender persons as to go to the very roots of what human rights are: the protection of the most vulnerable in society, the integrity of the human body and the right to be free from inhumane treatment.
Prof. Stephen Whittle, Jane Thomas and Richard Koehler represented TransGender Europe as experts. TGEU co-chair Julia Ehrt states: “It is clearly inaccaptable that a transgender person has to trade off legal properties like the right to integrity and self determination versus the recognition as a trans person.” It remains for example that in most European countries sterility and being single are forced pre-requisites to obtain name and gender change. Even more striking is that States are eager to deny that human rights violations and discrimination based on sexual orientation and gender identity exist within their boundaries. Even though the current Transgender Day of Remembrance counts alone 22 transgender persons, who were killed in 2008. Most recently Dilek Ince was killed in Ankara, Turkey for being who she was.

remarkable speech on transgender human rights by Human Rights High Commissioner
Thomas Hammarberg, Human Rights High Commissioner for the Council of Europe holds remarkable speech at the ILGA Europe conference ‘‘Thinking Globally, Acting Locally’’ in Vienna, October 31, 2008 -especially in regard to transgender human rights: My understanding is that the current EC Gender Directive leaves approximately 90% of the transgender community not covered. This has to be clarified - all transgender persons should be protected against discrimination on the same footing as other groups.
